On April 2, 2015, Madge Stager, a woman residing in the New York City metro area, visited the MedRite Urgent Care center with complaints about respiratory problems. After an x-ray was performed and found to normal, Mrs. Stager returned home. The following day, she presented at the MedRite care center again with similar complaints. At this time, she was diagnosed with the flu and sent home.
On the evening of April 3, 2015, Mr. Stager wore up to use the restroom. She lost consciousness and was taken by ambulance to the NYU Medical Center emergency room. Upon arrival, she was admitted to the ICU. She never regained consciousness, and on the afternoon of April 4, 2015, she died.
Her surviving husband, Christoph Stager, retained the law offices of Ronemus & Vilensky to represent him in a medical practice/wrongful death lawsuit against MedRite Urgent Care and several of the physicians in attendance at that facility. In the lawsuit, it is alleged that a misdiagnosis of Mrs. Stager’s condition – namely, that she had pneumonia and the delayed diagnosis contributed directly to her untimely death. According to details in the Attorney’s Affidavit submitted by Ronemus & Vilensky, expert witnesses for the defendants are expected to present findings that x-rays and diagnostic tests were read as normal and there was no indication that pneumonia was the underlying health condition. The widower of Mrs. Stager maintains that poor diagnosis led to the wrongful death of his wife.
The suit is a combined action of wrongful death and conscious pain and suffering. Robert Vilensky, the lead attorney for the plaintiff, has worked hard to reach a settlement with the defendants in the case. At mediation, a figure of $500,000 was offered by the defendants to settle the case.
