We brought suit for our client against the hospital that delivered her daughter. The delivering doctor used excessive force during the infant’s delivery. This negligence caused an injury to the baby’s nerves emanating from her cervical spinal cord resulting in Erb’s palsy. Now 13 years old, the child suffers from significant limitation of movement of her left arm, hand and wrist. The parties agreed to settle for a total of $1.35 million as compensation for past and future pain and suffering, medical expenses and loss of future earning capacity.
