Our client, a mother, gave birth to her child at Mount SInai Hospital. While in labor, there were signs of fetal distress on the monitoring strips, but no action was taken to relieve the baby’s distress in utero. The infant child was born with Apgar scores of 5 and 7 (10 being the best) at one and five minutes after birth. The infant child did require early intervention, but has since been put into mainstream school and is doing well. Our client and we believe the child should have been delivered sooner, and the case was settled in our favor for $700,000.
