Fire & Gas Explosions

Too often, apartment fires are due to the negligence of the property owner or landlord, especially in New York City, including the Bronx, Brooklyn, Queens, and Manhattan. Apartments are not maintained, and property owners often don’t comply with city building codes. As a result, fires
break out, and residents get injured, some severely while others fatally. Many individuals and families end up displaced and have to find shelter elsewhere.

Faulty smoke detectors, sprinkler systems, fire alarms, and obstructed fire escape routes cause many of the fire losses in New York City apartments. For example, in June 2022, a fire in the Bronx killed 17 residents, nearly half of whom were children. The cause of the fire was found to be a
faulty space heater. However, it was also discovered that the property owners did not maintain the self-closing fire doors, which were inoperable and allowed the fire and smoke to spread throughout the building.

Failure to supply and maintain self-closing doors in a building with three or more residential units is the most severe infraction of the New York City housing code (known as a “Class ‘C’ violation”). Landlords must have self-closing doors in all public common areas and post clear signage warning renters not to prop them open. Ronemus & Vilensky brought a class action suit against the property owners on behalf of the residents, alleging negligence.

Medical Malpractice

Clients who have been seriously injured due to errors by physicians, hospitals, nurses, and medical technicians require expert legal representation to prove medical malpractice. We have been successful in getting clients millions of dollars in compensation because of medical mistakes that
damage patients’ health. For example, one of our cases involved a patient who was diagnosed with a stroke and was later operated on to remove a blood clot in his brain. The hospital was slow to  respond, and the patient’s health declined rapidly. He lived in a nursing home until passing away six months later. Traumatic Brain Injuries

The jury awarded her $10.8 million, which represented her lost earnings, future medical costs, and pain and suffering.

Construction Accidents

Contractors face several hazards on the job, resulting in severe injuries. These injuries are often preventable when proper safety measures are implemented. However, when we investigate the cause of an accident, we frequently find that negligence on the part of the owner or general contractor (employer) is often the cause. While on-the-job injuries are covered by Workers’ Compensation insurance, in New York, a worker may be entitled to further compensation depending on the circumstances surrounding the injury.

For example, New York Labor Laws 240 and 241 hold construction companies liable for injuries and accidents from dangerous heights and falling objects. Labor Law 240 requires all owners/contractors completing construction projects in New York to implement appropriate safety measures and provide appropriate safety equipment to protect workers erecting, demolishing, repairing, or altering a building or structure. Labor Law 241 specifically addresses construction, excavation, and demolition work. The law recognizes the unique hazards involved at a building or
construction site. It requires all owners/contractors to provide safeguards at these sites, holding them accountable if they violate certain regulations.
